Can i participate in mediation without an attorney?
Yes! We assist both represented and unrepresented individuals on a regular basis. The State of Utah has a great online court filing system and there are many other resources we can direct you toward. We also offer flat rate document preparation and filing based on the complexity of the filing.
what if I am afraid to do mediation, do I have to do it?
Mediation is a voluntary process. We cannot make anyone participate and usually the best outcomes occur when both parties are invested in the process and anything agreed upon. Mediation is also a completely confidential process and nothing discussed in mediation can be used for legal purposes in the future, with the rare exception of serious crimes or threats of violence that may come up. If you are engaged in a divorce involving children you will most likely be required by the State of Utah to at least attempt one session of mediation prior to finalizing your divorce.
Can I bring my partner/friend/parent with me?
Typically parties involved in mediation are allowed a “support person”. This individual will be bound by the same agreement to mediate and confidentiality. It will also be disclosed to the other party who is in attendance and that may or may not make the process more difficult and should be considered when parties choose to involve other individuals.
